Terms of Service

These terms cover the hosted smartist service at app.smartist.studio and demo.smartist.studio. Using it means accepting them.

What smartist is
A tool for musicians to manage a song catalogue, build setlists, plan gigs, and keep track of venues and organisers. It is built and run by one working musician, not a company with a support desk.
It is a personal, non-commercial project rather than a registered business. Nothing is sold here, no service is invoiced, and there is no commercial relationship between us.
Your account
You need a valid email address, and you must be at least 16. Keep your password to yourself · anything done with your credentials is treated as done by you. Tell us promptly if you think someone else has got in.
A workspace can have several members with different roles. An admin can invite people, change roles and remove members, and can see everything in that workspace. Invite only people you want to have that access.
Plans
The free plan includes the song catalogue, setlists, gigs and the artist hub, with a storage allowance and a limit on the number of songs. The Pro plan removes those limits and adds venues, organisers, import tools and booking features. The current limits are shown in the application.
Both plans are free. Pro is granted on request from within the application at no charge. Nothing is charged, no payment details are collected, and no card is on file.
If smartist ever becomes a paid service it would require registering a business first, and you would be told well in advance. Nothing would be charged without your explicit agreement, and no workspace would lose access to data it had already created.
Limits are enforced when you exceed them, not retroactively · going over a storage or song limit stops new additions rather than deleting anything you already have.
Donations
If smartist is useful to you, there are links to donate. Please read them for what they are: voluntary gifts to the person who builds it, not payment for anything. A donation buys no feature, no plan, no priority and no support commitment, and giving or not giving changes nothing about what you can do with the service. Donations are handled entirely by Liberapay or Buy Me a Coffee under their own terms · no money passes through smartist, and there is nothing to refund here because nothing was sold.
Your content stays yours
Songs, lyrics, recordings, setlists, notes, contacts · all of it remains yours. No ownership is claimed over any of it. You grant only the permission technically needed to run the service: to store your content, and to display it back to you and to the members of your workspace.
Your content is not used to train machine-learning models, is not sold, and is not shared with anyone beyond the providers listed in the privacy policy.
You can export everything from inside the application at any time, and you should · see the next section for why.
Backups are your responsibility too
The service is backed up, but no guarantee is made that any particular piece of data can be recovered. The export function exists so that your catalogue is never only in one place. Please use it.
Acceptable use
Do not use smartist to store or distribute material you have no right to, to break the law, to harass anyone, or to attack the service · probing, overloading, or trying to reach other workspaces. Automated access that degrades the service for others is not acceptable. Accounts doing any of this may be suspended without notice.
When you record contact details for venues or organisers, you are responsible for having a proper basis for holding them, and for how you use them.
Sharing features
Some features publish a link that anyone holding it can open, such as a stage view of a setlist, and a workspace can optionally open its song catalogue to the public. These are off or restricted by default and are your choice to turn on. Anything you deliberately publish is no longer private.
Availability
The service is provided as it is, with no uptime guarantee. It may be unavailable for maintenance, because an upstream provider fails, or for reasons outside anyone's control. Features may change or be withdrawn. Material changes to the service will be announced where practical.
Ending it
You may stop at any time and ask for your account to be deleted · see the privacy policy for how. Export your data first; deletion is not reversible.
An account may be suspended or closed for a serious or repeated breach of these terms. Except in cases of abuse, you will be told and given a reasonable chance to export your data.
The software and the service are different things
smartist's source code is open source under the GNU Affero General Public License (AGPL-3.0), and you are welcome to run your own copy. These terms govern the hosted service only. A copy you run yourself is entirely yours to operate · and entirely your responsibility, including for whatever data it holds.
Liability
To the extent the law allows, no liability is accepted for indirect or consequential loss, lost profit, or lost data. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Governing law
French law applies. Nothing being sold, there is no consumer contract here · but if that ever changes, you would keep the protection of the mandatory rules of the country you live in, and nothing in these terms would override them.
Changes to these terms
These terms may change. The date at the top will change with them, and account holders will be told by email about anything material. Continuing to use the service after that means accepting the new version.
